Do we need a new will?

Hi
This might be a silly question but here goes. When my father was alive a will was written and on his passing everything went to mum. If mum hadn't been alive at the time then everything would have been split between myself and my sister. So am I correct in thinking that a new will needs to be drawn up as the current one refers to someone, my dad, that is no longer with us.

A will should be written with forward-thinking, so a new will should not be needed.But if this didn't happen, maybe you should write a better will?Was your will, written by a professional and who do you mean when you say "we"?0

Your question is confusing, but I am assuming you are talking about your mother’s will, which if it is a mirror will have the same what if clause leaving her estate to you and your sister if your father had pre-deceased her.
On the face of it a new will is not required, but unless it is a quite recent will she should review the will as a lot of old wills contain obsolete clauses and no longer appropriate executors.
There is a deaths, funerals and probate board that is more appropriate for this sort of question.1 -
If your Dad just wrote a will on his own and your Mum did not write a similar one at the same time ( mirror wills as mentioned above ) then she will need to write a new one .
The exact situation is not clear in your original post .1
