                    Hi guys,
I hope someone can help.
In the post today a letter has arrived for my husband from Overdale Solicitors.
It’s addressed to my husband with ‘Dear recip_salutation’ as the header and then ‘We’ve been instructed to apply for a Writ of Control. It states a CCJ was entered against my husband in January 2020 and the client is Lowell Portfolio with a balance of £809.00.

My husband hasn’t a CLUE what this could be about and hes never received anything previously in the post and certainly nothing regarding a CCJ.  He’s racked his brains back years and recalls not completing a phone contract in about 2013 but nothing since and has never received any paperwork regarding this.  We’ve been living in our current property since 2018 so there’s no way any post has missed us from January 2020.
We’re just in a situation presently where we don’t know how to proceed ? The letter tells us we have 14 days to pay in full / set up a payment plan or contact them before they issue an application for a Writ Of Control. With genuinely zero knowledge of what this entails we’re scared on how to broach this so as to not accept any liability etc by contacting them lol but we’re certainly not going to ignore this.

Is there a court judgement ?
Have you checked your credit files ?

If he got a ccj in 2020 it will be on his credit files. You may be able to work out what it is as there may be another entry with the same balance.
If not then you note the issuing court and court reference, and ask the court to email you the particulars of claim.
You should then be in a position to- pay it, or
- get it set aside, or
- dispute it with Lowell by a prove-it letter

If they get a warrant then you have another option:- use an N245 to suspend the warrant and vary the order

There are three main CRAs and you should check all 3. This is Martins guide on how to do it for free.1
