Hi,
For the past 17 years I've had child support/maintenance saying I owe money.
I've sent proof of payments in the past which they've accepted then they change the name of the organisation and say I haven't paid again sending debt letters & baliff etc.
The last contact I got which had been sent to a different ex and passed on to me dated 2019, stated I owed £16025.98 covering years 2005- 2018.
This included £300 for the liability order.
I've sent proof of payments a few times over the years of bank statements showing the payments total £11130.00.
Stupidly I had also made some cash payments which I couldn't prove so I'll have to write them off.
This means I only actually owe £4395.98 in maintenance and £300.00 For a liability order which is unfair.
Following court hearing I was granted access to my child 10+ years ago which my ex went against and I couldn't afford to take futher.
I therefore started to put the maintenance money away for my son as she wouldn't give me new details of address/bank when she moved so I could pay.
I also didn't want to pay through the agency as they wanted more than I owed.
There was £5000 in my account for my son.
Plus £5000 I've been saving to pay for an operation on my legs so I can continue to work.
If I don't have this operation I fear I'll not be able to walk much longer and my doctors have said its not avaliable on the NHS.
Today I got a letter from my bank saying the CMS have taken all my money.
Its double what I owe.
I've tried to look for help and keep coming across the same story- bank accounts being emptied when money not owed and no help or way of getting it back.
If I can't work I'm screwed. Ive been sofa surfing to save up for this operation so now I'm skint, homeless and I'm gonna have to give up work.
I honestly feel like giving up and just have no where to turn.
If anyone knows where I can get help and advice please point me in that direction.
I just feel so isolated and unable to do anything.
Its not right they can do this.
The bank even told me they don't need a court order they can just take anyone's money.
My online search vetifies this.
Thanks for reading and for any help

There are two places you can turn for help. Citizens Advice and your MP.
You need a statement from the CMS that shows how much Child Maintenance you were assessed as needing to pay and what you actually paid. You need to ask them to provide this, and make a formal complaint to them if they will not. You might make a Subject Access Request to get hold of all the data that they hold on you.
As you say, any payments in cash can't be proven, so you will have to write these off.
They are allowed to do this by the law. It is expected that people can and will prove that payments have been made and that the CMS administer the system correctly, and when this does not happen, for people to complain effectively. You have not done this so far, and now it is worth your while to get this sorted.
The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.1 -
Thanks.
I have previously raised the issue and proved previous payments sending copies of bank statements when it was the CSA.
Now its CMS they say I owe it again.0 -
