    make sure it falls into their garden, and then put up a fence against where it was/is

    Fences and walls are best dealt with by a give & take approach. For example is there something you can do that will improve his garden? Perhaps there's a tree overhanging you can prune/remove and a friendly conversation about once you do the tree he'll do the wall. Or that you'll put trellis up on the newly built wall and he's free to use it.
  • How do you know it's their wall op? Only asking as half the garden in the property we've just bought belonged to someone else without the owner knowing, until I checked the deeds. Are you absolutely, 100% sure it's not yours or a joint responsibility? 
  • Looking at your deeds and the neighbour's would be a good idea. I once owned a property where the deeds clearly stated I was responsible for maintaining a particular fence. I forget whether I owned the original fence
