Hi all,
I need help I had a bank account with Lloyd's tsb back in 2007.
They have tried to get money back over the years for a overdraft or something I can't remember what it was.
Over the years they have sold the debt to numerous companies, I have sent a proof of debt letter but never heard back from them, until the next company comes along and we repeat it. The other week I got a letter from carbot and today (new years eve) I got two phone calls in one minute from two different people one on my mobile and the other on my landline. I refused to talk about it and give no personal information.
They said that if I did not talk to them then they would send the bailiffs to my home. My wife is going through cancer treatment and I don't want to stress her out anymore.
They say the debt was £771 but they would close the debt if I pay £71. If I did this I would suspect they would continue to chase for the rest as that would mean the 6 years limitions would start again.
What can I do, I don't want the balliffs to my home.
Please help

Bailiffs cannot be instructed without a defaulted court judgement
Once a debt is statute barred it cannot be unbarred (Limitation Act 1980 s29(7))
If they are offering a settlement at 10% they know this is a dead debt.
Send Cabot the statute barred letter from the sticky threads1 -
I'd use the same method that they used on you. They wrote a letter so send a letter.2

Don't worry about debt collection agencies. They have no powers. Court Bailiffs do but if you are a vulnerable person they have to treat you different than normal.1

If so then Cabot`s inhouse customer service training is sadly lacking, as Fatbelly has said, they would need a defaulted court judgement to even consider this as an option, just another reason why you should never discuss anything on the phone with these people, the training they receive is virtually nil, and that statement proves it.
You obviously have better things to worry about with your wife`s cancer treatment etc, send the SB letter and that should be the end of it, if they magically pull a payment within the limitation period, out of the hat, which isn`t uncommon, post back for more advice.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thanks for that and I will keep everyone updated as I bet I am not the only one having this issue with them.0

Update:
So SB letter sent 2/1/22
13/01/2022 received a reply stating that they have checked their records and the debt is indeed statute barred and they also confirmed that my account will be closed and no further action taken.
So thank you again for the advice.9 -
Datxman keep hold of that letter confirming it is statute barred for when they sell it on and new chancers try their luck.
May you find your sister soon Helli.
Sleep well.1 -
Oh believe me I will be keeping it very safe. It says in the letter that I will not get any more calls from their agents. So I fully expect them to pass it on to someone else.0
