Furlough and Holiday Pay

Hello All
Does anyone have a definitive answer to the following situation?
A employee is working full time when they are furloughed in March 2020.
They were furloughed until the end of September 2021.
They were only paid the furlough payment for the entire period.
Do they still have their holiday entitlement from Apr2020 - Apr2021 and if so how many days?
Would the above if any was due be fully paid days?
How much holiday entitlement have they got from Apr2021 - Dec 2021?
Is there a limit when any of these days would need to be taken if they have any owed?

What does their contract say?Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0 -
28 days a year including bank holidays.

What does the contract say about the other issues highlighted - particularly whether they can carry forward any unused days?Carlisle1967 said:28 days a year including bank holidays.Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0 -
You have to take the holiday entitlement from the year, It cannot be carried over. However they were told that no holiday could be taken whilst on furlough.0

In that case, they had to make arrangements for their employee to take the holiday. They cannot simply refuse to allow them to take statutory leave.Carlisle1967 said:You have to take the holiday entitlement from the year, It cannot be carried over. However they were told that no holiday could be taken whilst on furlough.
Because of Covid, if statutory holiday entitlement is not taken it can be carried forward but not lost.0 -

Normally you can't carry leave forward, but I think a Covid exception to this has been allowed. It's along the same lines as if you're on maternity or sick leave, and can't take all your leave within the right year, you have to be allowed to carry it forward.Carlisle1967 said:You have to take the holiday entitlement from the year, It cannot be carried over. However they were told that no holiday could be taken whilst on furlough.Signature removed for peace of mind0
