i have had Cabot Financial chasing me for the last few months but I’m sure the debt is over 6 years old and not sure if they are trying it on. 

I have checked on clear score and it’s not had any payments on or missing on the account. It says I opened the account 11/2015 and it’s updated on 2/2019 I think is that’s when I moved address.

I’ve been getting letters saying it will be passed to their solicitors this week for a ccj but the account is over 6 years old or at least that’s how it looks on clear score. 

I have seen something about a letter you send if the debt is over 6 years old but it could open the whole thing back up. I want it sorted so I can relax this Christmas but I’ve got a feeling that’s what they are thinking as well.

if anyone has any advice please let me know the debt was for 2000 pound for an old aqua card that I got into debt witj

    If the account was opened in November 2015 it is very unlikely to be statute barred yet as you must have spent on it to have a balance, and I imagine may have made a payment to it when the first statement arrived (at a guess) December 2015? If you did not pay anything against the December statement, then a court would look at when you last acknowledged the debt (by using it or paying something against it), or the default date which would be around 3 months later. 
    You need to know when the last payment or aknowledgement was made to the account. Do you know when you last used or paid something to the card? 
    Credit card debt - NIL
    Home improvement secured loans 30,130/41,000 and 23,156/28,000 End 2027 and 2029
    Mortgage 64,513/100,000 End Nov 2035
    2022 all rolling into new mortgage + extra to finish house. 125,000 End 2036
  • I’m honestly not sure I definitely paid it for a bit but then I lost my job and moved out of the house that the debt relates to. Here is a pic of the default on clear score

    You need to check the 3 main credit reference agencies websites, not a 3rd party site that doesn't show all your information.

    Cabot can, and maybe will, start legal action on this if you continue to ignore them.

    Makes no difference what the accounts status is, if they start a claim, you need to know if its statute barred or not, in order to put in a defence to the claim.

    My advice initially would be to send the "provit letter" to Cabot, it can be found in the sticky section of this forum, its specifically worded so as not to acknowledge the debt, and they must provide evidence of your liability when asked in writing.

    There reply should tell you what you need to know, it also has the added benefit of putting everything "on hold" whilst your request is actioned.

    It it proves to be statute barred, you then tell them so, in writing, using the National Debtline, or MSE standard letter.

    That would then be the end of the matter.
