    Obtaining a judgement is a physical court process, its not dependant on any particular set of circumstances.

    As I said, original creditors don`t take you to court, if you don`t pay, they either sell the debt, or outsource it to a collector.

    Legal action is always a very last resort, as long as you interact with them, for example if you can`t pay, tell them why, they are not going to waste money taking you to court if you have no money to pay the debt.

    Less than 10% of defaulted accounts ever get taken to court, even if you did there is a process to follow under civil procedure rules which see`s to it, you have enough chances to make suitable arrangements without a judgement being obtained.

    The possibility of Legal action should not be your top priority here.
