Marriage Allowance if unemployed

Do you have to be in work if you wish to apply for Marriage Allowance transfer of tax allowance to your spouse? Apart from DLA, my partner has had no work or income for many years due to illness. Can she still apply for Marriage Allowance?

    No you don't have to be in work  - in fact, it's most often those who aren't working who can afford to sacrifice some of their tax allowance to pass on to a spouse with a higher taxable income who can benefit from it.

    As long as you are not liable to higher rate tax she can apply to transfer the allowance.
