unsure on which form to fill in to have case reheard......

someone i know is in a bit of a pickle. with bailiffs for a unpaid water bill, its partially due to a silly error, but it boils (sorry!) down to her not knowing about the case being heard some time ago, (last 6 months we think)
she filed the form with the paperwork for her ongoing divorce, and was sent to her solicitor (who was dealing with the divorce) so the paperwork for it was entirely missed..
the debt is now around 1000 pounds more than it was, due to ridiculous charges enforced by the bailiff (not the court)
im pretty confident with what i can find online its N244, however the odd place seems to suggest n245

can someone please confirm that it is 244 - most of the debt isnt hers, but the majority is, and obviously the divorce has kind of put everything else in the background.

    An N244 is a general form so should be OK for whatever you want to do .

    An N245 is just to suspend the warrant & vary the order. If that is all you want to do, then that's a better form as it allows you to suggest through an income and expenditure statement (part of the form) what the new amount should be.

    If you want to just change the monthly payment use an N245. If you want to actually dispute the balance, use an N244
  • thank you, changing the monthly payment wouldnt work, due to it going to bailiffs, (they have added on a lot - the first visit they didnt knock, just put a letter through the door - which put costs up - the second one had contact details - but more costs)

    if the case is heard, at least it will be for the original debt, making it manageable
