Hallmark Greeting Cards on Heart and Smooth – December 2021 

RULES 

1. The Hallmark Cards promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Monday 6th December 2021 to Sunday 12th December 2021 on the Heart and Smooth Network.  Global is the Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is Hallmark Cards. 

2. IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (Together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions. 

3. Anyone who enters the Competition (an “Entrant”) will be deemed to have read and accepted the Specific Rules and the Competition Terms and Conditions and will be bound by them.   

Details of the Competition: 

4. To enter the Competition an Entrant must go online to the competition page at  https://www.heart.co.uk/digital/win/ or https://www.smoothradio.com/win/ and register their details.  Online entry will open at 00:01 on Monday 6th December 2021 and close at 23:59 on Sunday 12th December 2021.  

5. Entrants will be required to nominate an individual who they would like to dedicate a message to of up to 300 characters, and by doing so, will be entering the competition to win the prize for themselves and their nominee. Of all entries, 3 Entrants will be selected from all eligible entries, based on the selected criteria detailed in point 7.  

6. We will select 3 entries in total as winning entrants. 

7. Selected Entrants will be contacted on the details given at point of entry to confirm their details and the next steps to receiving their prize. 

8. Winning entries will be chosen at random from all entries received across both the Heart and Smooth competitions. 

Eligibility: 

9. Entrants must be 18 years old or above.  

10. Entry is restricted to one entry per person per Radio Station; duplicate entries will be excluded from the Competition. 

11. By entering the competition, you confirm that your entry form and any accompanying materials and submissions: 

a. do not contain any material which is defamatory of any person or which is obscene, offensive, hateful or inflammatory; 

b. do not promote sexually explicit material, violence or any illegal activity; 

c. do not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; 

d. do not infringe any rights of any other person; 

e. are not likely to deceive any person; 

f. are not made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence; 

g. are not threatening, abusive or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety; 

h. are not likely to harass, upset, embarrass, alarm or annoy any other person; 

i. are not used to impersonate any person, or to misrepresent your identity or affiliation with any person; 

j. do not give the impression that they emanate Heart, Smooth Radio, Classic FM or Radio X, Capital and Capital XTRA.  

k. do not advocate, promote or assist any unlawful act such as (by way of example only) copyright or trademark infringement or computer misuse. 

Ownership: 

12. All competition entries and any accompanying material submitted to Heart and Smooth Radio will become the property of the relevant above radio stations on receipt. 

13. You agree that Heart and Smooth Radio may use your entry and accompanying materials on-air and on and any other platforms associated with the relevant radio station in connection with any publicity of the competition. 

14. You agree to grant Heart and Smooth Radio a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights, in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes. 

15. Where your entry and accompanying materials contain your personal data use this information can be withdrawn at any time by emailing privacy@global.com 

Prize: 

16. There will be 3 selected winners in total across the competition, who will each receive a prize for themselves, and an additional prize will be awarded to their nominated person. The winners and their nominated person will both win the same prize which is detailed below:

Additional Prize Terms & Conditions: 

17. At the point of entry, entrants must tick a box to confirm they have consent from the person their message is dedicated to in the entry that they are happy to be contacted by Global if selected as a winning entry, and for their story and relevant personal details to be featured in audio if selected. 

18. Once the winning Entrant has been contacted, Global will provide contact information for the Entrant to pass onto said nominee to contact Global and provide the required details to claim their prize.  

19. Dedicated message nominees must then get in touch with Global using the email address provided by the winner who nominated them, giving their personal details to receive the prize.  

20. Entrants and their dedicated message nominees will have 28 days from being notified of their win, in which to claim the prize. If they fail to respond within this time period they will forfeit their prize and a new entrant will be selected using the same process. 

21. We will endeavour to transfer the prize money to your bank account within 28 days but are not responsible for any delays. You must provide all necessary details via the method directed within 14 days after the original request to do so otherwise the prize will be forfeited at our discretion].  

22. The prize must be accepted as offered and no alternatives including cash will be offered 

23. Global reserves the right to substitute the prize with another prize at its absolute discretion. 

Data Protection: 

24.     Your personal data, and the personal data of any guest(s)/travel companion(s) that you or they provide to us, will be collected and processed by us, our licensees (including Communicorp UK Limited and Quidem Limited), Hallmark.co.uk, as well as the prize providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes.    

25.     We may hold your personal data for a period of 2 years in order to comply with our regulatory obligations.  

26.     You may be asked if you want to opt-in to marketing from us or our Promotional Partners when you enter a Promotion. If you choose to opt-in, we and/or our Promotional Partners (as applicable) will use your personal data for marketing purposes (see our Privacy Policy for more details). You can opt out at any time.  

27.    We, the Promotion Partners and the prize providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion. 

28.     By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy, which sets out full details of how we process personal data and how you can exercise your rights as a data subject. Please ensure you have read and understood our Privacy Policy before entering any Promotion. 

29.     You may request the removal of  your personal details from our database by contacting privacy@global.com. If you request that your personal details be removed prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable. 

30.    If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s)  have given you consent to provide us with their personal data.
