in Cutting tax
Right where do i start.....my now husband (27/10/07) moved into this house on the 28th aug 26th 07 and all was dandy till today i realised hubby has not been paying council tax and the landlord filled the form out as just hubby living here, the letter says he owes £772.62 this is from a sheriff officers. warrant date 30/10/07 as far as i aware this the first letter he has got.
i called them and they said i would need to pay 190 every month i explained no way can i afford that and could pay £100 on the 21st but she said well pay that and we will see after christmas.....so does that mean they
1.will still arrest his wages??
2.what do i need to do/or can do to sort this?
3.will we have to pay more with the landlord getting it wrong?
4.she is sending a form to send with all our in goings and out goings??
going out my mind with worry and not sure what to do or who to turn to for advice anyone give me sum plain talking advice please??
dont think i have ever posted b4 so be gentle plz!!

Unfortunately it is the residents job to determine with the Council as to whether they are liable to pay - you will be charged court costs.
I work in CTAX in England where in order to get to a Court Order then at least one bill and reminder and Summons will have been issued.
You need to determine if you have a formal agreement with the Council to pay or it was a 'just pay what you can afford' statement. in which case they probably will proceed with further recovery.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
Sorry Wendy, but your post doesn't make much sense. You give the impression the problem (because you were getting a 25% rebate as single liable person?) arises because your (now) husband moved into the property with you :-28th aug 26th 07
- and you didn't declare the 25% rebate was no longer applicable. But if you do mean 'Aug 07' - it couldn't have got to the court by end October? So is it an earlier date - or did he bring the arrears from elsewhere? Or is the date you've given '28th aug 26th 07' - even more wrong than it looks?
Either way - at this late stage - you need to talk directly with the Council despite they'e sending you an income and expenses form.If you want to test the depth of the water .........don't use both feet !0 -
Hi Wendybendy
Scotland is different from England - different names etc to officials - so bear with me.
I think you need advice from say the Citizens Advice Bureau. Ithink your landlord was correct - your husband is at your house.
The single person discount probably finshed as soon as he moved in - so arrears have been building up.
If you are suffering hardship you may be treated more sympathetically but as advised go and talk to the council officer (after the CAB).
You are unfortuneate because billing authorities are getting active in dealing with those who are getting SPD and for whatever reason don't inform them of a change of circumstances.
Best of luck and don't worry
