thanks Mouse400 just had an email about a Harry Potter win from the Warne Bros Comp you posted. Unfortunately they said because I hadn’t replied within 48 hours then they were offering the prize to someone else. I am meticulous in checking emails and I’ve searched back and not had any email from them prior to today. There was 200 prizes so wondering if anyone else has had the same? Thanks

    I have had a similar problem with a comp a few months ago.
    I complained but they replied it was in their T&Cs
    I advised them that may be the case, and that the T&Cs were unreasonable.
    I asked them to honour the prize or I would report them to ASA.
    Still no prize so I reported them to ASA
    I am now waiting for ASA's investigation.

    I would complain to ASA out of principle - but don't expect to received the prize.
    Unless the prize is time sensitive eg theatre tickets, 48 hours is unreasonable

    .Notifying the Competition Winners The Competition Winners will be informed by email within 72 hours of expiry of the Competition Period by no later than 23:59 GMT on 25th November 2021. The Competition Winners will be required to confirm acceptance of their Prize by email within forty eight (48) hours after receipt of notification of the Prize (“Confirmatory Email”). The Competition Winners must provide their full name, telephone number, email address and mailing address in the Confirmatory Email. The Promoter will inform the Competition Winners of any arrangements for the redemption of the Prizes.


    Terms and conditions should make it clear how winners will be contacted.  If there are time limits on claiming prizes these should be made clear in the terms and conditions to avoid unnecessary disappointment. If the time limit is considered so significant that it may affect a consumer's understanding of the promotion and their decision on whether or not to participate this information is likely to be considered significant, and should be included in the ad itself (rule 8.17).  A complaint about an online display ad for a prize draw to win a weekend in Disneyland Paris was upheld by the ASA because it did not state that the winner must respond to the confirmation email within 24 hours of receiving it in order to claim the prize. Whilst the full terms and conditions did include this information, the ASA considered that, as there could have been any number of reasons why participants were not able to check their emails over the period, the requirement to respond within 24 hours was a significant condition that was likely to affect their understanding of the promotion and as such should have been prominently stated in the ad (The Hut.com LTD t/a Zavvi, 13 February 2019).     It is a promotor’s responsibility to ensure that they take adequate steps and make adequate attempts to contact winners and alert them to the fact they have won. Ringing a winner once will not be considered sufficient (Walkers Snacks Ltd 28 August 2013).

    Yes it was that one. I definitely didn’t receive the first email as the one I did receive went straight to my inbox and I’d have seen the original one too. Hopefully it wasn’t the first prize of the Orlando holiday that I’d won!

    Email them and give them 48 hours to tell you what the prize is, and to confirm you are a winner.
    They gave you 48 hours to respond, now you give them 48 hours to respond, or you report them to ASA.

    Going to keep contacting them and do the ASA reporting if I don’t hear anything. I wouldn’t mind if it was something I’d like to win for me but it was Harry Potter and my daughter is a huge fan

    I entered thia as my daughter also a HP fan.

    If you go down ASA route, also mention they didn't tell you what prize was.

    I found ASA quite easy to use.  \They just want comp details and T&Cs. Plus the email(s) they sent you, then you just wait.
    They will do a thorough investigation but it takes time. Their email will also ask you not to ask for updates from them whilst they investigate. Also, if they find in your favour, don't expect to get the prize you should have won.
