I wont go in to the back story, it was m fault, I was away, and just didnt look through the post on my return, so I end up with a CCJ for just under 3k so finally I read the post find this out, and realise its the nasty horrid companies I have to deal with. so £50 a month is what they asked for. fine, ill pay them that, but absolutely no way are they having a direct debit from me, cant trust them as far as you could bury them!. then because of their incessant calls etc (all on the block list... when will they learn!), I would often pay them a few hundred, then back to £50 etc. Fast forward to now, and I have now had a letter from Mortimer Sharks, threatening me with the bailiff, because they haven't received any "payment proposals" from me. So I went through all the statements etc, and to date I have over paid them by almost £500 example £50 a month x 24 months = £1200 and I have paid over £1700. My question is, can they take me to court or sent the bailiffs just because I have paid a few time in the hundreds and missed a few £50 months? thank you for your time, and forthcoming responses

They can, because presumably the judgement stayed at the original wording which was to pay forthwith.
You can apply to 'vary' the judgement which will cost unless you can get remission.
Or you can ignore them as it will cost them to apply for bailiffs and this may just be bluff.
If this is a consumer credit act debt then they have to use the court bailiffs who are OK to deal with.
An N245 form does the twin job of suspending the warrant and varying the order should it get to that point.1 -

I could do a standing order, but that would mean communicating with them. And lets face it, no one ever wants to deal with those people, they are just nasty!

You can make one off payments from their website without the need for any contact, that would be your best bet, keeps everyone happy then -

If you already have their bank details (I was assuming you’d been bank transferring to them already) then would you need to contact them to pay by standing order?
