Payment arrangement after default

Hi all, if I make an arrangement on a default that goes beyond 6 years does the default stay on my account for 6 years from the date of default or once I’ve paid the debt?

  • The date of the default is the date of the default - nothing you do subsequently should change that.  Although also worth saying - if it is beyond 6 years it should already be off your history - are you saying it is still showing?

  • No, the default is 2 years but to avoid a ccj I am going to propose a payment offer but the offer will take me beyond 6 years so I’m just wondering what happens then..
  • The default will drop off at the 6 year point as it should in that case. And yes, better to avoid the CCJ if possible!

  • Your current debt will fall off your credit record 6 years after the default date.

    If a CCJ is obtained, it will remain on your record for 6 years from issuance of the CCJ regardless of the default date. (unless you pay in full within 28 days or so)

    If you make a payment plan, it will fall off your report as above, but it will not become 'statute barred' when it falls off your report. You will still need to repay in full.
