Request cca or not?

I've been paying of barclycard credit card for about 13 years through various debt collection agency and it has once again been sold on. Is it worth putting in a cca request or would the fact I've been paying all these years be an admission I  have accepted the debt?

  • Well if you've been paying it you HAVE acknowledged the debt - that's not the same thing as it being enforceable though.

    I would say yes given the timeframe of this debt.  When DCAs buy debts no documentation is handed over, so the current DCA will have to go back to Barclaycard and ask them for it and its likely they will not be able to locate it.

    As for the fact you've been paying towards the debt - this would only be relevant if you were looking for the debt to become statue barred.

    Makes no difference whatsoever if you have acknowledged the debt or not, its one of your statutory rights under the consumer credit act, to make a request under sec 77/79 CCA, at any time, as long as a balance remains on the account, to ascertain your position.
