SSP + Holiday Allowance

Hey all, I wonder if anyone can advise here? Long story short, had major op in April with complications, was on furlough until June and had a phased return in July. That lasted about 3 weeks and was signed off again. I have just had my Occy Health assessment and they have advised another 4/6 weeks before I even think about going back. Now, I have around 20 days holiday still to take, what happens with these? Our holiday run is Jan-Dec. Any help/advice would be great, thanks  😎

    What is your concern? Are your earning reduced as you are off sick? In which case your employer may agree for you to use holiday instead of sick leave.
    If you're being paid as normal whilst off work I'm not sure what else you would want? Short of carrying holiday allowance over to the next year.. which may come across as a bit of an insult as your employer legally doesn't have to pay you more than SSP.

    Statutory holiday can be carried over if it cannot be taken due to sickness. Anything above that would be dependant on your contract. But you should really have a conversation with your employer about it, because what the law might say is one part of the equation - the other part is how p***d off your employer might be at your continuing absence. Some employers aren't concerned, but others may start looking at capability after such a long absence. An agreed way forward may head off unpleasantness.

    If you are on reduced pay, it is also worth thinking about asking if you can take some of the time as holiday to get full pay.

    You shouldn't lose any statutory leave (If your employer gives more than the statutory minimum then you may not get the extra).

    Realistically, do you think you'll be back in 4-6  weeks? If you do, ask if you can take some of your holiday before you return.
