Can anyone advise please. I have a new job to start 4rd January and am required to give 2 months notice... can I give notice on Thursday (4th November) so that my last day of employment at this job is 3rd Jan? (Given that its a bank holiday and offices will still be closed from CHristmas)
I want to ensure a full months pay for December and currently 27th/28th December are bank holidays, then 29/30/31 are given to us by the company and Monday 3rd is a Bank holiday ??

Unless those "2 months" are defined in your contract to mean they have to be complete months (ie running from 1st of a month) then that seems satisfactory. ** (At one time I did have such a contract.)
When does your holiday year run, from 1 April or 1 January or some other date?
Please see my second response below - you need to give notice on 3 November, not 4 November, in order to finish on 3 January. (Still subject to that odd contract term not applying in your case.)0 -
It won't matter if they are Bank Holidays or not. If you are required to give 2 months notice, and give 2 months notice, you are entitled to pay for the entire period.

It's calendar months, regardless of which day of the week and/or hank holiday the last day falls on.

My new contract starts 3rd Jan which is the Bank Holiday so presumably new company will pay me for that day.
I will give notice on 3rd November stating my last day of employment to be 2nd January -is that right ?0 -

Notice runs from the day after you deliver it. So if you want your last day to be 2 January then you need to hand in your notice tomorrow, Tuesday. If you left it to 3 November then the notice would run from 4 November to 3 January.
Regarding the holiday year - remember that holiday is accrued pro rata to the length of time you are employed during the year. So if you leave at the beginning of January, you will have accrued only a quarter of your full holiday entitlement. So the Christmas break has to be deducted from that allowance as well as any leave you have taken since 1 October. Even if the bank holidays are mentioned separately as part of your entitlement those 8 days are still apportioned.0 -

The Christmas leave is basically Bank holidays Monday and Tuesday (as Christmas this year falls on the weekend), and then the Wednesday,. Thursday and Friday of that week are "gifted days" from the company which we get every year- so I am not using any annual leave over Christmas.
If I put my notice in tomorrow, then my last day of employment (although I will have finished before CHristmas) will be Sunday 2nd Jan0 -
I would also confirm with them that the last day you work (previously this might be phrased as last day in the office) will be Friday 24th December. I have never heard of "gifted days" but that makes them sound discretionary. They may still want to deduct these from your entitlement when you leave.
The bank holidays do form part of your annual leave - the part which you know have to be taken each year when there are bank holidays.

Stating a 'last working day' could cause confusion. Simply state the last day of employment will be 2nd January 2022.
