Hi, really need some advice regarding the above.

In 2007 I stupidly took out a loan for £2000.  I paid several instalments but was unfairly dismissed by a Trade Union and had a little bit of depression following that. In 2009 a Welcome Finance Rep came into my Grandmother's house and asked for payment!  I was taken aback and wanted him out ASAP,  He then produced a Credit Agreement for to change my payments from £239 to £80 a month.  It was never explained any further except to sign which I did under duress.  I then received correspondence later to say I have signed a new credit agreement for £5,500!  I immediately complained to WF but had no response.  However, I was bombarded with calls demanding payment and selling and rebuying my account with Cattles, Mackenzie Hall etc.  My Grandmother then sent token payments of £10 a month until 2014.  I moved out in 2015 but I received a letter from Welcome Finance in Sept 2017 with the offer of 10% for full and final settlement I contacted WF via telephone on 04/11/2017 and my gran sent a cheque for the settlement amount.  I felt a huge sigh of relief as I felt that was the end of the matter.  In 2019 I then receive a letter from Welcome Finance to say my account has been sold to EOS.  I then receive various threatening letter from EOS.  I telephoned EOS to say I had settled in 2017 with WF. They say they have no record.  I then checked my Grans account and the 2017 was not cashed.  I then spoke to EOS and explained the situation who said I sent an email to them with the WF letter and a cheque for 10% they would accept.  I then sent a letter with the cheque stipulating that if they cashed the cheque it would be acceptable of full and final settlement.  If not, contact myself to discuss further.  Again, no contact from EOS until Claim Form was sent to my Grans.  I checked and the the cheque was cashed in 2019.  What are my options?  I have sent a statute barred letter and settlement letter but no response.  I again panicked and emailed to offer £750  plus £250 on receipt of letter from EOS as full settlement.  They declined and came up with £3,800!  Help! 

Any advice?

  • It won't be statute barred as you've keep making payments.

    Find out what het total outstanding is. If you can't find the settlement sum, you'll need to agree another repayment arrangement.

    What did the WF letter re a F&F say exactly?
  • Hi Thanks for replying.  The letter stated that they are offering 10% settlement offer and to contact by 29/12/2017.  The letter was dated Sept 2017.  I telephoned on November 6th and confirmed a cheque would be sent.  I sent the cheque but this was never cashed by WF.  I then sent another cheque to EOS after speaking on the telephone who said that would be fine to send.  I thought that was the end of this but no.  My main concern or issue is the fact WF rewrote my original loan without my knowledge.  I cannot say I signed the Agreement as it was 2009.  I do not believe I did as I would have kept the document.  I have the original credit agreement signed but not dated.  My belief is that they rewrote the loan without my knowledge.

    Well, you have a lot going on here, cheques sent, and not cashed, re-writing of the loan, you claim you know nothing about, debts sold on numerous times, creditors have ignored you, I think the plot on this has been lost a long time ago.

    Lets begin again with this, and try to simplify things somewhat, starting with the current situation regarding the claim form, and the cheque that was cashed.

    If you settled the debt in 2019, then that is your defence to the court claim, there is no case to answer as the creditor accepted a full and final settlement of the debt in 2019, hopefully you will have kept evidence of this, that is your defence, and you should run with it.

    The other stuff is not going to help you resolve this issue now.

  • Thanks for your replies.  I have asked for a copy of the credit agreement.  They have no replied as yet.  I have chased this twice.
