Small claim - Provided with Care of address details to serve claim

We have a claim against the previous owner of our property where materials have been removed which formed part of the sale, a boundary structure without our knowledge prior to exchange and completion. We are claiming for the removed items.
The seller has acknowledged our claim and provided a care of address and name to move forward with mediation etc. The seller has also confirmed that the items were removed and she failed to tell us,
would this be acceptable by the court once I submit our official claim or would they reject it.
I have rang numerous government departments but no one seems to be able to give me an answer.
if I need their address what is the best agency to use to obtain these details.

    Have you contacted the Solicitor who performed conveyance in the sale?

    Other than that I believe it is a MCOL https://www.gov.uk/make-money-claim

  • Hi, yes we did originally and they have passed the letter onto the seller who then sent us a letter confirming we need to respond at the care of address, I think the solicitor wants nothing more to do with it as they have advised the seller that they are at fault

    I would imagine a care of address is fine if you have proof that is what they provided. As far as I'm aware you just need to serve them at the last known address. We had this with a builder we sued who moved around.

    Yes, last known address is all you need.

    That's what the most litigious companies use to get their ccj - then they look more intensively to find where to send the bailiff.
