Personal Injury Payment after discharge

Accident took place a year after discharge, it's now just over 3 years since discharge and will getting a lump sum from Personal Injury Claim in a few a months  ( I hope ). I used the MAP bankruptcy and was discharged after 6 months, so it's 3 1/2 years since going bankrupt. Do I need to inform the AIB of the money? There is nothing in the discharge paperwork from AIB that mentions the situation of coming into money after discharge,  however, I have read after 3 years I don't, but I have also seen 4 and 5 years mentioned. If I do have to notify them, would they take money off the claim amount ? I should add the vast majority of claim will be for Pain and Suffering, a few hundred for damaged property and nothing for loss of earnings.

  • The rules in Scotland are completely different to those in England and I have a feeling that you are liable to pay windfalls to the OR 3 or maybe 4 years after discharge. But obviously there are exemptions. I would call National Debtline and have a chat with them. They are open to 8pm. 

  • Having read their website I saw this. 

    If you gain new assets within four years of the date of your bankruptcy, the trustee may claim and sell them to raise money to pay to your creditors. This applies even if you have been discharged. Discharge means that your bankruptcy period has ended and the debts included in your bankruptcy have been written off. See the later section How long are you are Bankrupt. 

    I know in English bankruptcy that certain parts of a PI claim are exempt but I’m not sure about Scotland.
