Pilon/notice period after job loss due to medicall capability

Hello and thank you for reading.
I'm about to lose my job due to medical capability but my employer has told me that my contract says that it only requires them to give me 1 weeks' notice.
I've been employed for 20 years and would assume that I'd get the statutory minimum of 12 weeks but does this still apply after being medically terminated due to capability.

Thank you

  • Sorry but I am confused - an earlier post you made said that you will be getting 12 weeks PILON. Is that not correct? You are right that since the employer is dismissing you after 20 years service, you are entitled to 12 weeks notice. But obviously if you are getting PILON that would count as your notice pay, and you wouldn't get 12 weeks notice as well.
