Final leaving pay deduction advice

    Also even if off sick  most people are due full pay for the last week of their notice(when you resign)

    What notice did the company have to give to you(offten the statutory 1week per year)
    how many full years were you there.
    The OP said they had been employed 7+ years, which I take to be less than 8.  It is unlikely their contractual notice period was more than 8 weeks (ie statutory plus 1 week).
    So entitled only to one week's basic contractual pay as not working.

    If they did have longer contractual notice (eg two months) I think they may not be entitled to any pay as they have already exhausted SSP.
    As i had been long term sick there was no notice period needed to give as this was agreed between myself and the Senior manager. 
    Also the wage system doesn't work a week in hand or anything like that.
    As posted above i think that the processing  of the gratia payment via overtime may be causing a problem.
    Below is one of the responses i got but it doesn't make sense.. as i was off sick with no sick pay then i would just expect my accrued holiday pay amd the gratia payment and not any claw back of  basic pay and location pay.
    Below is what they said.... make sense of it if you can  :(
    I usually would have worked 12 days in a month so would have been 12 sick days a i was off long time sick.

    In relation to you pay query according to payroll departmen

    • In regards to the below query kindly be informed that the colleague is a leave effective 13/07/21. Until the date the leaving the colleague was supposed to receive only 7 days basic. However we can see that there is 11 days of sick coded for the colleague due to which 4 days is credit. Hence the basic and location pay is been recovered from the colleague.
    It reads badly and its just unexplained garbage

    As i had been long term sick there was no notice period needed to give as this was agreed between myself and the Senior manager.    Your contract was still in place and normally being on long-term sick leave does not change the requirement to give notice.  I hope your manager confirmed that  they were not requiring notice.

    :(   Agreed the "explanation" is worded rather oddly.  It sounds as though they were suggesting "days of sick" had been paid which were not due but that's a rather wild guess on my part.

    I think I would ask for their itemised statement of all the sick days they have paid and when and what exactly were the dates of the payment of the basic pay and location pay which has been deducted.

    By agreeing to no notice you potentially lost a weeks pay.

    It's the employer notice that determines if the week pay is due, not the employee notice.
