Old Mortgage Shortfall

I've been going through old files and come across some paperwork for our mortgage from our last house, which is in my husband's name only.  There is a letter from April 2008, not long before that house was sold (we moved to another provider in both names and that is paid off in full).  It warned of High Risk of Shortfall.  I claimed for the mortgage I had for this and received a settlement, but, to my knowledge, my husband never claimed for this.  So, the question is - is it too late?  I suspect the answer is, "Yes", but I don't want to dispose of or archive the documents without checking.  Tx.

  • If I were you, I'd keep the document for now and check in with the lender and / or the financial services ombudsman perhaps.


     
  • I remortgaged my flat and lent the money to my brother to start a business- long story short he did not pay I was away for a while and not aware of the situation. Flat was re-possessed. Years later I settled the matter with the then Lambeth Building Society which is no more. At the time I had £900.00 pounds in an account which I had been saving for my young son. When I tried getting access to the account Lambeth Building Society informed me that I was no longer entitled to that sum and that they had claimed that £900,00. 
    I did reluctantly let the matter rest because I didn't know what to do. 
    Is there any action I can take retrospectively?  I would appreciate any advice on this matter.

    Way out of time if your below comment is when it happened:
    "About 30years ago I remortgaged my flat and lent my brother the money to start a business. I was away working. He didn't pay and I lost my flat"
    Mortgage started 2020, aiming to clear 31/12/2029.

    As Lambeth BS ceased to exist 15 yrs ago, not only would you be way out of time, but there is a probability their old records no longer exist. If LBS used your assets to offset your debt, that may well have been permissible.

    Ask your brother to pay you back?
