Hi

looking for a bit of advice please

i had a secured welcome finance loan in 2006 anyway after them hassling me in 2012 for one missed payment and a torrent of abuse over the phone I did a SAR which shows charges and Ppi and not the correct amount borrowed so tried to follow this up with a CCA which ended up in a serious dispute then with them sending me a letter saying they can’t locate my CCA had several debt collection agencies on my case but each time I said please return to welcome which they did then 2018 received a letter from coast financial solutions saying they had purchased the debt then it went quite until March 2020 when I then sent them copies of my CCA request to welcome with copies of postage and copies of received signatures at welcome,then they replied to say they was investigating my complaint in December 2020 saying sorry for the delay and offered £50 compensation if I sent my bank details which I didn’t,but anyway they said welcome didn’t supply my CCA and neither can they so they’ve reviewed my account and agree they will not be enforcing the agreement and have halted all legal proceedings and offered 50% of moneys owed.Now yesterday I receive a letter from them saying notification of Recoveries Action saying despite our recent correspondence and attempts to contact you,which they haven’t apart from sending statements your account is now being managed by our recoveries team for the full balance,you can phone and pay by card or send a cheque in the prepaid envelope provided,you need to contact this office urgently there are number of ways we can discuss your situation.

Any help would be much appreciated and thanks in advance

    they have said December in writing that all legal action has been halted due to not being able to comply with my cvs request but have now sent a coast recoveries letter

    they have said December in writing that all legal action has been halted and they will not be enforcing the debt due to not being able to comply with my CCA  request but have now sent a coast recoveries letter

  • The lack of CCA means it is not enforceable, they can bluster and splutter all they like, provided you have not acknowledged the debt in the last 6 years and they don't have a CCJ

    thanks for your response,there is no ccj and no payment has been made since 2012 although it is a secured debt which coast has transferred into there name and it also disappeared of my credit file years ago.
