Help re PRA & CCA

my Halifax debt was sold to PRA, I asked them for a copy of the CCA, Today they have emailed a document which has my current name and address on it, however nowhere on it does it have my signature or any dates? I need to check my paperwork to see if I can find out whether this card account started at this address or previous one.  Is this valid as a CCA ? Any help/ advice I would be grateful. Thank you

    If it's a reconstruction it can omit the signature but must have the T&Cs that existed at the time plus the address you used when making the application
  • I have received another email today asking if I have lived at address (they gave my previous address) surely if they have the CCA and details they should know that? I have asked them to get CCA with correct address and come back to me. To be honest I wouldn’t be able to confirm if the t &c’s are the same. I’m trying to find old paperwork but my filing is not great and when moved house I paid it all off ( feeling very stupid debt built up again however it is going down now and no credit being used for the last 6 months at least with pots for regular expenses etc and EF building) . Think this will be a debt that I will negotiate a payment while trying to build up enough to do an offer for full and final settlement. Just want to make sure they are doing it legally.

    Laughs out loud - legally, Hmmm, they don`t have the CCA, it never leaves the original creditor, only when you request a copy of it does it make an appearance, and that`s if the OC can muddle one together.

    Debts are bought and sold without any of the formal paperwork changing hands, so these debt purchasing companies chase you for the full face value of the debt, having bought it on the cheap, and without knowing whether the legal paperwork even still exists, its like gambling, but on a massive scale.

    To be enforceable, they must produce something that at least resembles a valid credit agreement, estimates vary, but a good 25-30% of accounts have no compliant paperwork for them.

  • @sourcrates thank you, this is my dilemma this looks like something they have put together and somehow ( probably on a credit report or something similar )found a previous address for me . Am I right in asking them to provide CCA with right address on , not me confirming an address for them? I know I am probably going to have to pay up in the end but hoping I can settle for a % of the debt. I have a deferred pension paying out later in the year ( not enough to pay all of it) so would be great to get rid of it.

Am I right in asking them to provide CCA with right address on , not me confirming an address for them? I know I am probably going to have to pay up in the end but hoping I can settle for a % of the debt. I have a deferred pension paying out later in the year ( not enough to pay all of it) so would be great to get rid of it. 
    Never, never confirm or give information about addresses.  If they have the address, good for them, but if they don't, never give them the information they need to make up a CCA.

  • I did not give them my previous address😀 just told them if they have the paperwork they should be able to supply it. Having checked email again there was another attachment which is the original agreement and has my signature but has a different account number! So have queried that! I’m resigned to the fact I will end up paying but will make sure they have the right paperwork!
