I have a debt with MBNA and from 2008 to December 2020 have been paying Stepchange. Outstanding debt is £1450 and I was previously paying £131 pm to them and have paid £11,000 off for MBNA debt between 2008 and 2020 (the monthly figure has changed over the years with other debts being paid so more money for the debts still o/s). I owed £21k originally across 5 debtors. Lost a well paid job and couldn't afford repayments so went on DMP.  The debt/default is no longer showing on my credit file as gone way beyond the 6 years. 

The debt was transferred to Arrow Global Guernsey and paid them via Stepchange. 

I requested a CCA from Arrow Global in September 2020 who said they had requested the information from their client and returned my postal order . I gave them 8 weeks to provide it but nothing. I had sought guidance elsewhere and was advised to stop paying as they hadn't produced a CCA and stopped paying in December 2020. 

In February 2021 it seems it was passed to Resolvecall and they  were ringing me about 5 times a day and also arrived at my house.

I then received a letter from Drysdenfairfax solicitors on Thursday. Have DF bought the debt? They want the o/s debt of £1450 paid with 10 days. 

Has anyone tried a FF with DF? They have also asked me to complete a financial statement. 

Any advice on how to proceed with this given they haven't or Arrow Global haven't provided a CCA? I didn't think they could go for a CCJ  without a CCA?

    Yes they can start legal action, but then your defence to that would be no compliant credit agreement.

    Dryden Fairfax are the tame solicitor of Arrow Global, they probably will have been asked to litigate, and won’t be aware of the lack of CCA.

    You can write to DF informing them of the lack of credit agreement, and that Arrow Global failed to comply with your request.

    TBH I think that would put an end to this, as they won’t flog a dead horse.

    Send the letter, see what happens.
