Temporary 4 on 4 off

Hi, I have a question.
I am about to take on 3 months if 4 on 4 off shifts of 12 hours and 1 hour break. Employer says I am to be paid for 38.5hrs a week.
Surely a temporary contract shouldn't be pro rata?
I calculate the total shifts divided by 3 months to be a 42 hour week.
Surely my employer can't say I am to work 3 .5 hrs a week for free!
Thanks in advance

Ask them to explain their workings to you: it may be that the light will dawn on them, or you may have missed something.Signature removed for peace of mind0

Does it take you under minimum wage?0

I'm minimum wage already and it would mean I am working 14 hours a month for free0

Based on a 12 week period rather than "3 months". Your hours compute to 38.5 per week. You'll accrue a weeks holiday over this period.0

My contract is from 1st July until 30th September. I work 46 days during this time. 506 hours (with break taken off) so this divided by 3 then by 4 is 42 hrs per week.0

There are more than 4 weeks in a month though, there will be 13 weeks in a 3 month period.Lwatson26 said:My contract is from 1st July until 30th September. I work 46 days during this time. 506 hours (with break taken off) so this divided by 3 then by 4 is 42 hrs per week.0 -
Think of it in 8 day periods: 4 days on/4 days off. That equals 44 hours paid work: (4 x 12) - 4 hours break = 44.Lwatson26 said:Hi, I have a question.

But a week has 7 days, not 8, so your pay for a week would be based on 44 x 7/8 = 38.5.
Given the number of days in the period 1 July to 30 September doesn't divide by 8, there will be an adjustment to your final pay packet to cater for this.Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!3 -
Long term 4on4off is 3.5 days a week average, for 11 hour days that 38.5hr 1 July to 30 Sept(inc) is 13 weeks 1 day(92 days) That's 11.5 4on4off cycles so will need some adjustment depending where the days lie. if you are starting 4 on then the easy fix is to have 12 cycles and have the 4 days off at the end rolling into Oct.Lwatson26 said:My contract is from 1st July until 30th September. edit to add a notes
The alternative if they want to pay just over the 13 weeks period.
(Actual period is 13weeks 1 day)
If you start with 4on and end with 4on that 48on 44off over 13 weeks
48*11/13 = 40.6248hr for 13 weeks.
You also need to check how they plan to accrue and take holiday.
if this is a single standalone contract then a final payment for 63.73 hours will be due
also the 3.5 days average for 4on4off needs a multiples of 8 weeks to complete the rotation.0 -
It depends on whether you start with a 4 on or a 4 off, but I would guess 4 on, you will then finish with a 4 off over 92 days. That's 48 on 44 off that you should be paid for and the 38.5 hours per week equivalent is wrong, depending on how they pay you.
If they pay monthly they can either pay you for the days worked or 176 hours (11hours per shift*48shifts/ 3 months).
If they pay weekly it should be 40.1791 hours (11*48/92 days*7 days in a week)
Whichever way you need to be paid for 528 hours0
