Aoe unpaid by employer

Hi,
I'm wondering if anyone can help me?
So to give everyone some background i had an attachment to earnings order submitted by my local council (council tax) which was fine however from march to October 2020 my employer was taking the deductions from my wage and not directing the money back to the council!
My employer is currently sitting on £360 and has for the last 6 months ignored me and the council with regards to getting this money back.
I have all proof of deductions however the council is now telling me i must re pay the £360 again to them as there's no way they can recover it from my employer as no one is willing to respond.
I am still employed by said company and i have no idea how I'm to get the funds back, i have contacted every single department to no avail.
Any help is appreciated.

You would have to send a Letter Before Action to your employer asking that he returns the money to you as you have now had to pay the council directly. If they refuse, then you sue for the amount via Money Claim OnLineIf you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales1

The council can take action against the employer. It is an offence to fail to comply with an attachment order. The council could, if they wished, prosecute the offence in the magistrates'. In nearly 20 years of working in council tax I've never known a council do so however, which is unfortunate.The council are right however that would owe them the money and then you'd need to chase the employer.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.1
