Can you claim you’re in a wrong council tax band if you’ve built an extension on your property?

Options
Hi,
We moved into our house in 2006 and built an extension in 2015-2016.
We have always been in a higher tax band to most of our road.
The houses are ex council properties so built in exactly the same way, same size etc, but for some reason our house is in Band D when most of the road are in Band C.
I’ve gathered all of the information and our house was worth the same as the others in 1991 so it would seem we have a case.
But is it worth applying if we’ve had an extension as our house is now bigger than some?

Any help would be greatly appreciated 🙂

Thanks in advance!

They are quite likely to decide that you are in Band E now that your house is bigger. Councils need to raise money, and asking for a banding review makes you a sitting duck.
The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.

It is an interesting one from the legislative angle.

Assuming you are in England CT legislation says that a band cannot be increased on account of works carried out by the current owner after 1 April 1993. But there is nothing in the legislation which says such works cannot be taken into account when considering if the band is excessive. In the old days of domestic rating, the term used was "rebus sic stantibus", which freely translated meant you had regard to everything that existed on the day of application for a reduction or subsequent inspection.

As you are well out of time to officially appeal, I think that VOA would just turn down your application for a band reduction.
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
  • Thank you for your help.
I wish we’d known about this before we built the extension 🤦🏽‍♀️
