hello my father pasted away a year ago.
he had an outstanding debt which he was paying off, i have received a letter form the company asking to call to make arrangement for the out standing debt £3200..

i will call, i just wanted to know what questions i should be asking.

i have do idea of what the debt is, does his family have to actually pay this debt are we responsible now for it?

he left his family with not money.

If he left no estate then the debt  is no one's responsibility. They may tell you that you have to pay but you don't.
Lost my soulmate so life is empty.

I can bear pain myself, he said softly, but I couldna bear yours. That would take more strength than I have -

No you won't have to pay it (or any other members of the family) I wouldn't call them i would send them a letter to advise the estate is insolvent.
The only way another person would be liable is if they signed as a guarantor for the loan/debt.

could this company not make a claim for it against the house? his name was on the mortgage / deeds. The mortgage is still being paid off.

will they now view the house as his estate?

  • i wouldnt give them any information or engage with them further.

my understanding is that before he die, he was joint named on the house, its now in my mums name.
so this maybe classed as his estate, something he owned.

    Hi,

Do not engage with them on the phone, you should proceed with this in a timely manner, and do everything in writing only from now on.

Inform them of the death, include a copy of the death certificate (if you can, as they will ask for one) inform them there was no estate left, and that any and all liability ceased at that point.

You now consider the matter closed.

The house now belongs to your mother, in order for them to get there hands on any money, they would have to take your father to court and obtain a CCJ and charging order, they cannot do that now for obvious reasons.
