Claiming back additional 3% Stamp Duty

Hi all,

Hoping somebody can share their experiences with HMRC on claiming back additional Stamp Duty within 3 years of selling a second property.

The standard path to being able to claim back stamp duty would be:
- buy new property
- sell ‘old’ property
- claim back stamp duty.

HMRC have asked me to provide details pertaining to this. However, my circumstances are slightly different. Sadly, due to the breakdown of my relationship I’ve actually sold the ‘new’ property - and moved back to the old one! So the events are:
- buy new property
- sell new property & move back to old one
- claim back stamp duty

The final position is essentially the same - I now have one property. But do you envisage HMRC being difficult about paying the additional stamp duty back? Appreciate your advice, as I’m concerned I will get turned down for the refund.
