Hello, I hope anyone can give me some advice. I took out an amigo loan with my sister as a guarantor in October 2019. At the time I was mainly concerned about any detrimental impact this may have on my sister as she was planning on applying for a mortgage at the time, I was informed on numerous occasions (as was she) that the loan would have no impact whatsoever on her ability to get a mortgage even while it was still ongoing which we have now found out is not true as it has to be put on her affordability assessment and currently is impacting her ability to get her mortgage, if I had known this at the time I would never have taken the loan and she would not have agreed to be a guarantor. There was also an occasion last year when I informed them I had been made redundant due to covid-19 they contacted my sister before attempting to come to a solution with me. Because of the situation and the impact this has had on my sisters mortgage application I have been absolutely crippling myself financially to get this paid off ASAP and I have been paying 3x more than the minimum payments but as a result I have fallen behind with other things. I contacted Amigo to see as I only have £423 left to clear whether there was any way they could help as a gesture of goodwill considering they gave us both misinformation at the beginning and they just quoted the T&C's re interest and that they could not help.
I just wanted to know if anyone with any experience with regards to a mis-selling claim with Amigo has any advice or whether anyone thinks I have a good basis for a claim for mis-selling?
Thanks in advance for any info

Not on the basis of affordability for a future mortgage for your sister, as that's up to each lender to determine. £423 won't be making practical difference.
With such a small amount to clear, I would do whatever you can to get it paid off.1 -

This is a section from the terms and conditions of being a guarantor from the Amigo website, it clearly states the following -
"The CRA`s will add details of our searches and your application to the record which they hold about you. The CRAs will also add details of your loan agreement with us, the payments you make under it and any default or failure to keep to its terms. Your credit-reference agency records will be seen by other organisations that make searches with those agencies".
You should always bear in mind the printed terms and conditions applicable to the account will always take precedence over anything that may be said in a phone call, with a call handler, this is because people get things wrong, its a basic fact of consumer law.
So aside from some pretty atrocious customer service, they haven`t done that much wrong.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
