Capquest Student Loans

Help needed!!!!
In 2015 I moved to another address and started a position whereby my credit was taken into account. Soon after moving I received threatening letters from Erudio Student Loans I'm assuming because I registered on the ER.  I was told by Erudio that if I didn't make payments to this very old student loan (1997!!!) that my employer would be contacted and wages garnished.

Naturally I began to pay, not realising that Erudio should have proven the debt to me and that the loan had been statute barred as I had met the threshold wage wise for the past 20 odd years. However...I paid 50 quid a month and then the payments stopped being taken. I'm assuming that this was due to perhaps the company changing names to Capquest in the interim. In these intervening years I heard nothing.

Fast forward to early 2021 I started getting letters from Capquest and found a number of articles stating I should ask them to prove the debt and informing them the debt was statute barred as they shouldn't have even taken payment in 2015 without proving the debt.

They replied stating the debt was not barred due to the payments in 2015 and they'd be in touch re proving the debt. In the meantime I received letters threatening to send a company round to sort out the payment!

Today (10/06/21) I received a letter from them stating that they included my "agreements from Student Loans Company" and I kid you not...its a scam of something that's 1/4 of an A4 page I'm size. Nothing can be made out aside from a date in Sept 1998!!!

They have also offered me an available discount! My question is....what do I do now? In my mind...they haven't proven the debt, simply obtained an agreement, none of which can actually be made out and the fact they're offering a discount tells me, they're at it.

Is this something I should seek legal advice for? Can I ignore the letter? Should I write back to ask them to provide the actual documents?

Sorry for the long post also! Any help and/or advice would be gratefully appreciated!

Jo

Capquest are a debt purchasing company, Erudio must have sold your debt to them.
This is National Debtlines take on things -

"The Limitation Act says that the limitation period for student loans is six years.

Old-style student loans usually became due for repayment in the April following the conclusion of your course, and any limitation period could not begin until after you missed a payment on your loan. However, if you asked for your loan to be deferred within the six year limitation period, this would have restarted the limitation period. If you think your loan may be statute barred, contact us for advice".

Might be best running your situation past them, as student loans differ to consumer credit act debts, in the evidence required to prove its SB.
