Company not offering pension?

Went for a job interview yesterday & asked about their pension scheme. Interviewer said the pension amount was built into the salary and they didn't offer a scheme. When I expressed surprise at this, he became quite defensive and informed me he'd checked it all out with his accountant. I did a quick check when I got home and as far as I can see, there is a legal requirement for companies to offer auto-enrolment pension schemes. Anyone know if there are exceptions? Also, if he is breaking the law, who I would report it to? I have no desire to work for the company, so have nothing to lose.

    If all the staff were earning less than £10k they would not have to have automatic enrolment (but would have to provide a pension if someone requested it).

    If all the employees were directors of the company they would not have to.

    But yes, in all other circumstances they legally have to have an auto-enrolement pension if they have employees.

    Could be you have to pass probation first? My current company do not pay a pension and I truly believe it is all linked into the passing of a probationary period.
    I’ve heard all the weird things right from I don’t know when payday falls through. It took over 3 weeks into the job to learn when payday was happening! A lot of things I’ve had to take with a pinch as salt as I just get the feeling it was a say anything by someone a few years younger only to later hear something else completely different in back track. I kind of did start to wonder if they had ever been an Employee at one point or whether it was a situation of being a director since 18 and saying any old think when it came to hr and payroll matters.
    As non of the companies in 2021 will have paid into any pension I am beginning to understand why short term work is favoured.

    That sounds likely - it would be easy enough to misunderstand something, particularly as the interview process can be a bit on the stressful side. More likely the answer meant to say (although possibly didn't actually say) that you won't be auto-enrolled until you've been there 3 months, which is allowed by the legislation. 
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    Could just mean it's taken off your salary before you get it. If your interviewer didn't work in finance or payroll they may be a bit clueless on the mechanics of it.

    Normally that isn't a good question to ask unless the interviewer asked about incentives, unless they asked your for your salary expectation and you said the exact figure depends on other factors like the pension scheme.  

    You obviously know that employers are supposed to offer a pension scheme so it sounds you what you wanted to know was if they offer the minimum level or offer an enhanced level scheme
