ParkingEye Ticket - I didn't park I was waiting in my car

Hi please could someone give me advice. I have a parking ticket from ParkingEye which I appealed and lost. The fact is I arrived to pick up my daughter, I didn't park in a bay but just at the entrance and I did not get out of the car at all. I was there for 12 minutes as she was late. I didn't purchase a ticket as I was not parking and didn't realise that i needed to as I didn't leave the car. Should I just pay the fine as I don't have a leg to stand on or should I now take my appeal to POPLA?

Your choice , but time on site waiting is parking , and you exceeded the Grace period stipulated in the BPA CoP , so if it was a pay and display car park , non payment is bilking
Unless Parking Eye failed on landowner contract , signs and POFA , you will lose at Popla , probably in Court too , unless you can convince a judge
Parking Eye tend to have ticked all the boxes , so personally I do not believe that you can win , but I am happy for you to prove me wrong
Never use private parking unless you fully comply with the signage , as driver you are expected to seek it out , and comply , or leave , you did none of those things2 -
The driver parked. It's irrelevant whether the driver stayed in the car, left the engine running, or got out and danced a jig. The car was parked.
Please read the sticky thread for NEWBIES then appeal to PoPLA using all the template points available to you from the third post of said NEWBIES.
Get pics of the site and signage.
In future, park on a public road. As long as there are no kerb blips, stopping to load/unload goods and people is permitted.

You never know how far you can go until you go too far.2 -
If your car is only shown right at the extremity of the entrance, you could argue as part of your POPLA appeal that you didn't enter the site or drive past the entrance sign (if true). The rest of the POPLA stuff is as per the template.
But hey, you have 33 days to use a POPLA code. A month to get the landowner/retailer to cancel it with one email (the easy route - PLAN A in the NEWBIES thread).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
