Landlords deposit

whilst pursuing a deposit return from a landlord he went into bankruptcy, I had already obtained a Judgment for claimant before this happened, as I tried to enforce payment I was told that I could not continue because of the bankruptcy, so I had to wait until he came out of it. (I was too late to be put on the creditors list} Assuming that he had no money I applied for and was able to secure a final charging order, he challenged this in court, then we went into lockdown and the hearing was suspended for a year, the judge threw out his challenge and granted me the order, believe it or not this has taken almost 7 years. Now my original Judgement has expired!. I am just not prepared to wait for him to sell the property, and believe the only way forward is enforcement, my question is must I apply for another judgement, OR can I appeal to the court for an extension of the original judgement, any advice would be greatly appreciated

You must go back to court and seek permission to further enforce this judgement.
The court will want to know why you have not sort to enforce this earlier, you would say this was due to his bankruptcy, i assume.
The court will take all facts into consideration, and decide accordingly.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. thank you I will do this, just one other thing please, would it be the last court I was with? it started at Bury court which then closed down was transferred to Salford and ended up at Liverpool who actually lost all the paper work and asked me to help them by providing all the paperwork that I had in my possession

Your local county court yes, you may have to ask the court what the exact procedure will be, but if there is no record of the judgement, you may struggle, do you still have your copies of the paperwork ?I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
