Land charge

Hi all,

I am discharged bankrupt and I am buying a house and the land charges search came back showing me as having been bankrupt. No issue disclosing this as cash buying due to inheritance.

But I'm worried that it will affect sale somehow? I never owned property when I went bankrupt so am I able to get my name removed from the land register? Or will it not actually affect much?

I've spoken to land charge and they said I need a court order permitting the vacation/cancellation of the charge, they couldn't advise me how to get one. Anyone had this before?

Have a look at sections 34, 49 and 50. It will stay on for 5 years but you can apply to the court to have it removed if it’s causing a problem. If you’re buying for cash, and it sounds like you are, I wouldn’t be concerned about it now you’re discharged.

Thanks, yea cash purchase mainly from family after inheritance but was just worried it would affect the purchase but if it won't I will just wait for it to drop off then, thanks!
