hi all hope somone can help
my girlfriend has been divorced for about 2 years now but still has bank account with ex-husband.(neither of them use it.)on it is about £2000 overdraft. the bank are constantly phoning her at home and at work and sending letters to ask her to pay it off. she has been into bank and offered to pay £20 a month and has asked them to phone or send letters to ex-husband so he can pay half, but they are refusing to do so as they only have one number and address....hers.
the bank wont accept other addresses and numbers from her.
we are about to buy a house together so any help, ideas or website links would be most appreciated.
thanks in advance.

I'm afraid they are both 'Joint & Severally Liable' for the debt.
Meaning that they can chase either party for the full amount.
See:

and
http://www.debtquestions.co.uk/legal_jointseveral.php
The bank will chase whoever they perceive to be the easiest party to extract money from.

maybe she could pay it off then take him to small claims court to recover half. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

Sorry, I'm a tad confused to what you actually want advice about?

Hi ss77
Was the overdraft created by the two of them or just one of them?
If both, what percentage of it is hers?
Does she have an address for her ex?
not sure on details but she has his home address (and has a recent payslip to prove it), his parents address (he sometimes stays there) and his girlfriends address( he sometimes stays there too)0
