Resigning and covid test

Hi all

So my partner was sent home from work the other day as they asked what was up with him. He said he just has a cold that he got from me. I have done a lateral flow when I realised I had a cold.. It came back negative.
So anyways they asked if he has lost his sense of smell he said well I'm blocked up so yeah.. So they sent him home. They told him to get a pcr test. It's ridiculous because he doesn't actually have the symptoms listed on the government website. He has been sent home in the past for clearing his throat and made to grt a test. So he had to lie to get a test to be able to go to work. If you select no symptoms the list of reasons for a test doesn't include employer asking for one. 

He has since found another job in an industry he loves. He telephones his job and asks them how much notice he needs to give. They said are you still in probation and he said yes. They said well because your in probation and you really need a negative result to come back you can just leave now. So after that telephone call he sent an email with his resignation stating as agreed via telephone my resignation is effective immediately. 

He has had a reply back asking for the result of his test which he is yet to get as he feels he will be lying to government. Also if they agreed via telephone  that there is no point in getting a result for them why are they asking now.

So coukd you advise us what is best to do.

    Is there a reason he resigned with immediate effect? Did he not want his notice pay?

    The timeline makes no sense.  The partner was told to get a PCR test and apparently got one albeit by lying about having symptoms.  I thought loss of smell was now identified as a symptom.  He has since found another job so why is the employer asking for the results of another test.  Has the partner had a test or have they not?  If they have found another job since being sent home, how long have they been off work?

    Well he has been looking. For work for a while and he has secured a job since this happened.

    He has booked a test as i got to see the email. It's so that they can check as he has been around other people at work. He doesn't tell me the full story.

  • So has he had a test or not?  (I presume not if he doesn't want to lie to govt or to his employer - otherwise your post makes no sense at all as he could just tell his employer the result).

    As per juraj.kecso, they want to know the results in case they need to inform his work colleagues.  Seems reasonable to me.  There may be no reason in employment law for him to tell them the results but it seems a bit churlish and selfish not to do so.

    (Why on earth did he give any suggestion at all that he may have lost his sense of smell - a recognised symptom of Covid and indicating the need for a test - if all he had was a blocked nose?)

    The employer is possibly being over cautious, but they have a duty of care to their employees to avoid contact with anybody who has Covid or to order those who have been in contact to take the appropriate isolation actions.  That is not the employer being a pain, that is an employer doing what they should do.

    Perhaps best that he did resign as obviously not a good working relationship.

    Not employment law
    A positive result should be passed to track and trace an all close contacts identified for them to follow up.
    With employment setting they sometime put a local team on the case and look at surge testing in the employer.

    Workplace containment is a still a serious problem, they are second after schools for the most outbreaks.
