Sky Mobile Online Promotion on Heart and Capital, May 2021 – Specific Rules.

1.     The ‘Sky Mobile Online promotion’ (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from  Wednesday 5th May to Sunday 23rd May 2021on the Heart Network and the Capital Network.

2.     IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here. Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions.

Details of the Promotion:

3.         To enter the Promotion, you must go online to the Promotion entry page at https://www.heart.co.uk/win/ or https://www.capitalfm.com/win/, register your details and play the dating style swipe game.  To play the dating style swipe game you will have 30 seconds to swipe left or right on various images linked to the four themed prize options. Swipe left if you want to ‘dump’ the image, or right to ‘love’ it. When the 30 seconds is up, one of the four themed prize options will be recommended to you based on how you swiped on the themed images. If you don’t agree with the prize option recommended for you based on your swiping, there will be a drop down menu to select an alternative prize from the four prize option availiable.  

4.         Online entry will open at 00.01am on Wednesday 5th May 2021 and close at 23.59pm on Sunday 23rd May 2021. Entries received before or after this time will not be included in the Promotion.

5.         Within 7 days of the closing time of the Promotion, all eligible entries will be entered into a draw. One correct entry will be selected at random – one winning entrant will receive the prize they select at time of entry outlined in Points 10.1 to 10.4. The winning entrant will be contacted by one of our representatives via email or the telephone number they have entered. If the winner does not respond within 28 days from being contacted, they will forfeit their right to the prize and we shall be entitled to select another winner by another random draw. That subsequent winner must respond to the notification email within 28 days of the date on which they are notified, or they will also forfeit the prize. 

6.         We and Sky Mobile may publish and publicise your name, your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to your association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion.

7.         In relation to winners, you understand that we and Sky Mobile may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture.

8.         The Promotion is only open to residents of the UK aged 18 and over, and who are based in the UK at the time of entry.

10. There will be one winning entrant who will win one of four prizes as outlined below:

Prize Terms and Conditions:

11.  Sky Mobile’s agency, TPF will be responsible for providing all of the prizes for this promotion. Global will pass on the winners’ prize details to TPF who will then be in touch about redeeming the prize.

12.  Barcelona trip terms: Prize package for 2 people includes; Return flights from London to Barcelona, including taxes, fees and one item of checked luggage per person; Return private airport transfers in Barcelona; 3 nights’ hotel accommodation in Barcelona, with a four-star rating, based on sharing a double or twin room; Daily breakfast; 3-hour daytime boat trip, including BBQ lunch, drinks, snorkelling equipment and inflatables; £500 spending money; Travel insurance. 16.  Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from the enjoyment of the prize; and/or any postponement, cancellation, delay or changes to the prize beyond the Promoter’s control; and for any act or default of any third party supplier.    

17.  By entering the competition, if you are the winner, you agree that you and your guests (if applicable) agree that Sky may make your full names and counties available and may use your full names, counties and photographs for post-event publicity purposes without your permission or paying you anything.  You further agree and agree to procure that any guests agree to the use of your names, images and any video or voice recordings of you or your guests (if applicable) in any media in, perpetuity, as Sky sees fit.  You agree and agree to procure that your guests agree that the copyright (if any) and all other rights title and interest in and to any contribution by you or your guests shall vest in and be irrevocably assigned to Sky 

18.  Sky reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that Sky reasonably regards as inappropriate, offensive or unlawful.

19.  By entering this promotion and choosing to opt-in to receive more information, you agree that Sky may use your information to contact you about offers, news products and services you may like. 21.  Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner.  

22.  We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes.   

25.       We may hold your personal data for a period of 2 years in order to comply with our regulatory obligations. 

26.       You may be asked if you want to opt-in to marketing from us or our Promotional Partners when you enter a Promotion. If you choose to opt-in, we and/or our Promotional Partners (as applicable) will use your personal data for marketing purposes (see our Privacy Policy for more details). You can opt out at any time. 

27.       We, the Promotion Partners and the prize providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion.

28.       By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy, which sets out full details of how we process personal data and how you can exercise your rights as a data subject. 29.       You may request the removal of  your personal details from our database by contacting privacy@global.com.
