HOIST FINANCE

I have received a letter from Hoist Finance saying they have taken my loan over from Robisnon Way.  I have been paying RW £5 a month since 2012.  But have always disputed that I owed the money to Lloyds, Due to a complaint at the time from 2010.  I asked Hoist to get a copy of the original agreement which they are unable to do.  What should I do next please.  Should I just continue to pay £5 this would never be paid off and does not appear on my credit file as far as I can tell.  Thanks

    You have made a CCA request? Is that correct?

    if they are unable to provide, the debt is unenforceable. I would stop paying

    Hoist and RW are the same company. 

    If you dispute you owe this, you shouldn't be paying.

    Was this an overdraft, credit card or loan?
  • fatbelly, it was for a loan, I agreed to pay Robinson Way £5 a month back in 2012, as was going through the ringer and just agreed to get them of my back.  Have asked Hoist to provide a signed contract which they cant.  Would I need to let them know I am not going to pay or just not contact them again?

  • JAS2015, I cant remember it was 2012, i was in contact with Robinson way and to get them off my back I agreed to pay £5 for the rest of my life as would never settle the debt at that rate.  I asked Hoist to get a copy of the agreement from Lloyds and they cant?

    It's best to do a formal request (in writing, £1 postal order, quote the Act) - then they either reconstruct the agreement or it becomes unenforceable.

    Then it's safe to stop paying
