SOA: new way of living

    Surely your sister must have have some income from benefits for herself and her daughter? If so, I think she'd be expected to contribute to the household income from this.
  • I am a student and have to drive 15 mile to college one day a week- no bus would get me there on time. We also live in a village and it would cost us more on the bus to travel anywhere.
    The car I drive is my husbands, He also has a banger that he drives to work on the days, we are going to take that one off the road and just use the one car. WE need the family car as we cant all fit in his heap (no seatbelts in back for littleones car seats)

    I understand people point about my sister paying her way and she does realise it also but- she get £90 a fortnight for JSA, from this she needs to pay 55 a week rent, feed, clothe herself and travel expenses. she has just moved nearer to me with a view to sorting her life out and having her daughter back in the future, she has taken the first brave steps towards change and is trying to get a full time job- she is aware of our situation and is doing all she can to help. She has made some bad choice lifestyle wise and is making positive changes. She has debt problems also that she is sorting. Our parents do not help- I am not prepared to put any more pressure on her. She has been here for a week and already has a christmas job- and is applying all over the place for a permenant job. She realises and want to contribute - she wants employmen and once she has it is aware I will be expecting contributions.

    Also on the BK form it asks if you support anyone else - at this time I am feeding my sister do I put that there??

    My husband has a credit card so obviously that is an expense we will have to take into account - does that go on my SOA-?? I also assume that as we have joint accounts that are overdrawn he will become responsible for that debt so do I budget for that too- Yes PANIC has set in!!!!!

    For the credit card, if he is the primary card holder then it is his debt anyway. Don't list it amongst yours.

    An OR won't officially allow you to make payments towards his debt out of your income, but how you privately juggle your finances and use any surplus income you are left with is up to you.

    You can put everything you want to down to do with the car/travel, but the OR may disallow it. But they can't allow it if they don't know.

    Traveling to visit relatives is unlikely to be seen as essential either as an expense or a reason to keep the car. It's likely you would have to meet that cost from any surplus or from another section of your budget.

    It is up to you to make a convincing case that the car is essential and not just convenient. Have a look at the info in the link below:

    I'm really not being awkward but I'm still unclear as to whether your sister's feeding herself or whether you're feeding her. However much you want to help her, I can't see that if she's on benefits,ie. receiving money from the state to support herself, you can claim her as some kind of dependent.
    Sorry if I've misunderstood the situation.

    It is rather complicated - she was on JCA when living in northants, she has moved to devon and has got a christmas job within days- because the job centre didnt transfer her claim and her land lord hasnt returned her deposit as yet she has no money untill she gets paid (friday). She is signed off the JCA and because the claim is between offices they have told her she is not entitles to any of the benefits you get when yu get a job (uniform allowance) So when she is at mine to see her daughter I feed her and I have also given her food from my cupboards to feed herself whilst she is at hers. I cant see her starve! :)I dont wish to claim as her as a dependant but on the BK for it asked who else you support and at this moment she is costing me money so I decided its better to put it and be told they wont class it than to not put it.

    Fingers crossed she has a job interview tomorrow for a permenant job and also a room in my village is up for rent so that will be better all round.

    Thanks for explaining. As you say, you might as well put it down but I'm sure it'll be knocked off. After all, it's bound to be a very temporary measure as she'll either get a job or get her benefits sorted out, either way having money coming in by the end of the month. I think that the OR's looking at a longer term situation otherwise you could count someone as a dependent if they were visiting for a week!
