Not as clued up as I thought I was....

Hi all 

After nearly 12 months of following I have finally decided to post. I was all for going BR. Stepchange helped with my SOA. Spoke to my employer to make sure emplyment won't be effected ( I work as a secretary for a solicitors). 

In the process of raising my BR fee. Applied for the Gov account and filled in just the beginning of my personal details. 

I think I need to re-do SOA as I have £170 surplus left each month ( I would actually love to have that). 

But what has stopped my tracks is that knowing they need Husbands income etc. I seen another thread down the line about one pays all bills and other pays for non bills. Were in the same position. Husbamd pays all utility bills and rent and from mine I transfer the short fall (£200) and use mine for food shop, petrol, clothing, personal care etc but husband is now concerned as we also have car on HP (his name only) and is concerned that may get taken off us ? 

Feel like a stop - start - stop the past 12 month and kick myself thinking I would nearly be out of it by now. Does anyone have a number for a free BR adviser who I could call to find out all the silly little questions ?

    - If you put your Statement of affairs on here you will get some useful feedback. You can generate one at Stoozing.com, then choose the MSE format and copy and paste it.
    - If you put your full household income and allocate realistic amounts to each section, it shouldn't make a difference who pays what, as long as you can show what is spent in total.
    - If the car and its payments are in your husband's name and it can be proven, the car shouldn't be taken off him, and you can include car payments as a legitimate household expense. 
    - You mention that you had spoken to StepChange, why not contact them again? Or you could also contact National Debtline (https://nationaldebtline.org/)

    The car can`t and won`t be taken off him, as he is not going bankrupt, and its in his name, only you, as the bankrupt, are subject to the OR`s scrutiny.

    Step change or National debt line are the leading sources of information to take note of, also try the debt camel website, that`s another good read.

    Do your income/expenditure as suggested above, no matter how you do it in practice, you just need a budget to fit the circumstances you are about to deal with, all the OR want`s to see if you have any surplus income, how you divide the budget in real terms is up to you.
