ACI collections

Hi, I have recently received an email regards my debt I owe. Asset collections have had it since 2017 but have never reported it on my credit report. I’ve been paying via my DMP and Stepchange. They sent me an email last night saying they are now going to report my defaulted account with the agency’s! Seems a little unfair considering they have had it for 4 years.
the original creditor was Avant but I can’t see if they defaulted me or not, my credit report says settled from them in 2017 which is when they passed it over.
I’m now stressing that a default is going to appear this month even tho it was 2017 that took my account? Any ideas what date the default should be registered as?

Defaults can be registered at any time on an account where contractual repayments are not been received.

However, guidelines state they should be applied at between 3-6 missed contracted payments.

So you would have grounds for complaint, to have such a default back dated.

What happened when the original creditor
Never defaults you, and now the debt agency just randomly picks a date? Should they default you when it’s passed to them?

It would have defaulted before they sold it in 2017.

Can you work out when you last made a payment to this, before the default?

If it was 2015 then they can put a default on and it will get removed this year!

No it wasn’t defaulted when they sold it on. I checked today with the original
creditor and they never defaulted me.
marked it down as arrangement to pay and then sold on.

That was naughty of them, but becoming more the norm these days, if ACI do now default you, you will have cause to make a complaint, your argument would be the default should be backdated to when you first got into trouble with your payments.

Follow the complaints procedure, then escalate to the FOS and/or ICO if necessary.
Complaints can take time, but there would be a reasonable chance of success here.

Unfortunately I don’t have time on my side 😞 we are going thru a mortgage application where we did fit the criteria but after this default appears. It’s likely we don’t! I’ve already had another creditor so this - Hoist/vanquis. I sent a complaint to the FOS and heard nothing back!
