Hi All, need some advice please.
I have tried claiming back from both amigo and provident using resolver through this website and following advice.
Amigo are going to court to try and get a repayment scheme set up so they only have to pay a fraction of the claims.
I also have been trying to claim from provident, and it would seem that they have been waiting to see what was happening with the Amigo case. I say this because like many other people I have been given excuse after excuse as a delay tactic only to receive a letter on Saturday stating that they too are now looking at applying for a scheme through the courts.
my question is, as I opened my claim against them and it went over the 8 weeks, then I complained to ombudsman but went over another 8 weeks, have I a case that this should have been dealt with prior to their application for such a scheme and a failure to comply with their obligations?

My understanding is they have 8 weeks to send you a full and final letter with regards to your complaint.   You cab go to the ombudsman if you receive a deadlock letter (regardless of time scale) or at the 8 weeks point of raising the complaint.

    Fot example
    Letter written 01 Jan 21.
Dead lock letter recieved 20 Jan, upon reciept of the letter you can go to the FSO.
    or
Eight weeks has passed and youve heard nothing then you have the right to complain to the Ombudsman

But as you say, Amigo will go bust if they dont settle on a figure and Provident are just about to start their review of the situation.
