Make up the missing payments as soon as you can, to avoid the debt increasing.
Stay out of court at all costs - it doesn't sound as if you have the available funds for a trip through the legal system.2 -
I don't really see the problem here.
Presumably when they stopped calling you put the repayments to one side knowing full well that at some point in the future they would be in contact for you to make the payments. Obviously you now have the money put aside to pay them now that they have made contact.
Or I suspect most likely that wishful thinking got the better of you and you decided to spend the money instead, hence why you are now posting on here.
It's unlikely that you will be going to court unless you refuse to pay them now they have made contact, but be under no illusions in the event that they do issue proceedings your above argument isn't going to do you any favours. Just because they stopped calling does not mean that you no longer owe the money, carry on like that in court and you will loose.
Make contact with them and pay what you owe, if you have spent their money own up and make a payment arrangement that you can afford to pay and don't be pressured into paying more than you can afford.
If you can clear the arrears in one go (because you put their money aside instead of spending it) you probably have a decent argument to get any negative entries removed from your credit file. If you can clear the arrears in full I'd say you probably also have an argument to get any late payment charges or penalty interest refunded. Other than that I wouldn't push your luck.
Don't try the "you've broken your contract and now I am not paying you" argument, it isn't going to wash mate.
Good luck.8 -
Collection agents for these companies come and go, they are mainly commission based after all, and what with the current pandemic, knocking on doors collecting money is not the safest of things to be doing right now.
I don`t understand your refusal to re-start payments, if its an attempt to opt out of paying your debt, then think very carefully about the potential consequences of your actions.
Doorstep lenders will not take action through the courts, its too time consuming and costly for them, no, instead, if you continue to ignore the debt, your lender will just wash their hands of the account, and sell it on to a company such as Lowell, or one of the multitude of other debt purchasing companies, now they may get legal with you, as they have previous form for doing so.
CCJ`s will mark your credit file for another 6 years, making life even tougher for you, as I said, think very carefully about what you do here, you might regret it.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Personally I would not make further payments without a full statement of the debt and payments. Some of these people will keep knocking on the door after the goods have been paid for. It's best not to purchase from people like this. You are paying the salary of the collector as well as for the goods. It's not unusual for the cost of a used item to be equal to a single installment on the never-never.0
