Thanks Sourcrates, will do.0

Just an update Sourcrates and Fatbelly and other members who have been kind enough to help me. Well no update really as to date I have not received anything and no further communication at all.
Is this the norm? No word either way at this stage?
I somehow thought that they would push and continue to jump on me and was scared of the post arriving initially but that’s getting a lot easier and it is what it is I guess.0 -
Hi,
Yes quite normal, I would assume someone is scurrying around at shop direct trying to piece together a reconstituted agreement for each of your accounts held with them, burning the midnight oil in the process.
Or, more likely, Lowell already know the evidence won`t be forthcoming any time soon, and are just dragging things out.
An oft used tactic for which they have previous form.
Its all speculation at the moment, again the advice is to just wait and see what happens.

So finally today and now I have calmed down I have received what can only be described as a huge pile of paperwork itemised purchase lists for starters which is the bulk.
Heading letter says copy of agreement, default notice and statement for account.
There is a credit agreement which I know sounds stupid but it is blank of any factual information regarding the account at all , no name, address, or any personal details on it at all printed, signature bit other side also blank.
Credit limit blank, APR blank, standard interest rate blank, cost of credit blank. No dates anywhere. The gaps where there appear to be there to have information added are just white spaces.I then have what I can only describe as what look like data captures from a computer screen printed on a glossy paper my name and address on it and dated 09/06/21.
account number and sold 26/10/20 other than that I don’t understand anything else on it to describe.
Sorry it’s also saying respond by return, if I do not agree a resolution to this matter we may request that the court issue a county court claim against you.
Huge help now pleas please? Thankyou so much.0 -
Right keep calm, nothing is going to happen quickly despite what they say.
Hang on and the CCA experts will be along to advise youIf you go down to the woods today you better not go alone.0 -
So the original agreement (if there ever was one) cannot be found and this is pre-2007, where s127 still applies.
If you receive a court claim that would be the time to take advice from here

Thankyou so much , now I have studied everything they have sent me I have rightly or wrongly concluded that most is junk ie the itemised print outs. So I’m left with 2 blank credit agreements that could be sent to anyone 2 glossy screen capture things and 2 summary of accounts name DOB and debt total.
Just twigged aswell they rolled 3 accounts not 2.0 -
Sorry Fatbelly I missed your response, sorry to be thick do I set up a payment plan now? Are the documents correct and enforceable? As you can tell I have no understanding of the process despite reading everything possible and googling S127.
Thanks again0 -
You can
- arrange to pay the whole amount in instalments
- make an offer to settle with a lump sum
- see if they issue a court claim and defend it - you have the ammunition to do that if you wanted

Sorry Fatbelly, so I’m in no different position to last year? I feel like I have waited for ages to be a yay or nay to moving forward and am still in the same rut.
The accompanying letter reads pretty much the same as the start, any slight idea of timescales to move now court wise ie back to that 30 day notice thing?Never a good time I guess but ill health now aswell, well could have done without what seemed like a tree of paper being delivered today. On that basis you just have to laugh I guess, better than crying all the time.0
