CCJ and bankruptcy

Evening everyone
A friend of mine was issued with a CCJ of £14’000 after a issue with a previous rental property.
He then went bankrupt as a result of this and the CCJ was included in the bankruptcy.
He’s been paying £100 each month towards the debt since going bankrupt.

I thought if you went bankrupt and the debt was included, then you don’t pay the debt? Or is it different with a CCJ?

Thanks in advance

Are these former tenancy rent arrears that he's paying?

It is towards the CCJ that was issued due to the house being trashed when his ex gave the keys to squatters who caused loads of damage
  • By friend, you mean you. Welcome.
There are circumstances where debt rolls over even through bankruptcy. It is to prevent sever abuse of the system. I am led to believe certain court orders can be included depending on the conditions they were enforced.

If he's under the Official Receiver he shouldn't be paying this.

He needs to talk to the OR about this and they will probably try to reclaim what he has paid, as it sounds like one creditor has been treated preferentially

They will also want to know where the money has been coming from as any surplus money would normally be paid direct to the OR for 3 years.

CCJ`s are extinguished in bankruptcy, i am assuming the "friend" still rents from the same landlord, that is the only reason he would have to continue paying the debt.

Sourcrates - That's what I was trying to establish but I think the answer was that it was a former tenancy.
