Deed of variation for land management fees

Hi, the house that I am in the process of buying has a land management fee for the local green areas that all local residents are contracted to contribute to annually. There is a clause in the deeds that allows the management company to reclaim monies not paid from the property. As this is not something that mortgage lenders like a deed of variation has been requested. The management company have already had the request for a number of weeks but yet to respond. My question is has anyone else had this experience and how long did it take to resolve, were you successful in obtaining a DOV? The only other option is an indemnity policy but I have concerns that when I come to sell in the future I will have a problem if a buyer isn’t comfortable with an indemnity policy because to be honest I am not really! My own buyers are getting quite impatient as we are ready for exchange, really looking for light at the end of the tunnel!

  • Hi there OP, I know a little time has elapsed since your post, but I'd be very keen to hear what happened if you didn't mind elaborating? 

    We are in exactly the same situation but as a seller rather than as a buyer (i.e. our house is a former new build and our buyer has requested a deed of variation)

    How long did it take to resolve? Did it all go ok in the end?

    One post each and not active here for 3-4 years so I wouldn't be too hopeful of an answer...
